Apply by August 3rd for Permanent Outdoor Dining Program ‘Dining Out NYC’

SoHo Broadway Partner: Eligible food service establishments may apply for outdoor dining in the roadway, sidewalk, or both!

Food service establishments (FSEs) participating in the current temporary outdoor dining program must apply to the new Dining Out NYC program by August 3, 2024, to maintain their current temporary outdoor dining setup. Non-compliant FSEs must dismantle their setup at their own cost. Upon application approval, FSEs have until the earlier of 30 days or November 1, 2024, to meet the program’s design requirements.

• All eligible food service establishments are welcome to apply citywide
• Equitable fee structure:
  • Rates vary by location and cafe size 
  • Rates are lower than pre-pandemic Sidewalk Café program 
• Cafes will be safe, accessible, and easy to assemble and break down

  • No more fully enclosed structures 
  • Roadway cafes allowed for an eight-month season (April through November) 
  • Sidewalk cafes allowed year-round 
• Licenses and revocable consents required, valid for four years

NYC DOT offers an optional online, searchable directory of companies that provide design, fabrication, installation, removal, storage, and/or leasing/rentals to support compliant outdoor dining cafes. This resource may serve as a one-stop-shop for restaurants looking to build roadway or sidewalk cafes. This Directory is meant to be a helpful resource and is not a requirement for the Dining Out NYC program, restaurants may choose companies, or products at their own discretion.
